The incident of a clear violation of the road agreement with UPC took place on Saturday April 12, 2008 on Moore Road. A transport flat bed trailer hauling a tower section for the UPC industrial wind project has been parked and abandoned in the low part of the gully on the south side of Moore Road. Two bills (Senate 5908 and Assembly 8697) have been introduced in the state Legislature to re-authorize Article X of the Public Service Law that governs the siting of major electric generating facilities. Although not specifically mentioned anywhere in the proposed legislation, wind farm projects that meet certain kilowatt threshold capacities shown below would also be included in the siting review process along with power plants.

For SCIDA to approve this PILOT before the court hears the cases would be injudicious. If Mr. Sherron's assertion is correct (CWW disagrees with his interpretation) that SCIDA can lawfully approve PILOT's after construction has started, there should be no immediate or compelling need to authorize the PILOT for either UPC Prattsburgh or Cohocton Projects, at this time and with tax exemptions purported.
